Workplace closed for a week due to floods but I was already on a weeks holiday. Can I claim an extra holiday because of this?
My workplace closed all last week due to the water being off and the flooding. I was already taking a weeks annual leave. I am now informed that I cannot claim the weeks holiday back! Is this right or should I be able to claim it?
You will not be able to claim an additional week merely because your place of employment was closed for the week you planned to take your holidays. Had it not been for the appalling weather conditions over the past weeks, presumably the business would not have had to close and you would have taken holiday as arranged. If the holiday had been arranged a week later there would have been an extra week off. You will thus have the holiday to which they are contractually entitled and does not have grounds to make a complaint to a Tribunal.
If you were badly affected by the flooding and unable to take advantage of their week off there may be a possibility, on compassionate grounds, perhaps of asking the employer for some additional days off in lieu, but, I really think that would be highly unlikely and the employer would certainly be under no obligation to do so.
