Whiplash injury caused by workplace accident from loose carpet tiles at work. Can I claim compensation?

I work for a Security company as a security officer. In the control room there are carpet tiles which were loose as I sat on the office chair I pulled myself forward and the wheels of the chair jammed between a gab of some loose tiles. This then caused the chair to tip forward. I grabbed the desk to stop myself from falling forward which caused a sharp pain in my neck and shoulders. I informed my manager of the accident and completed the on-site injury accident book. I was in pain and I used some painkillers to help. I completed my shift but during the night the pain would not go away. In the morning I reported in sick and went to the hospital and was told by the doctor that I had suffered whiplash. I was of work for 8 days four of which were unpaid rest days. I sent the company a self certification form and a copy from the doctor stating that I attended the hospital. I was given painkillers and anti-inflammatory tablets. The problem is that my employer has only paid me for the day that I worked and for the day I returned to work and I was told that I would not be paid for the first three days off as sick pay. I have returned to work but my neck still feels stiff and I feel some pain still but not as much as before.

Your employer has a responsibility to maintain a safe place of work and that includes making certain the carpet tiles were properly affixed. Not to do so is a clear case of negligence for which you can claim from their insurer. You have a claim for pain and suffering and also from loss of earnings. In addition you sound like you need private rehabilitation treatment which we can arrange at no cost.

I have asked our First Response team to contact you to assist you. They will go through the case with you and arrange the legal and medical assistance you need to make a successful compensation claim. If you would prefer to call them, their helpline is 0800 037 1066.
