What should I be looking for in a compromise agreement? Since a restructure at work in 2005, I suffered from major depression for almost two years. Subsequently I received a poor year end appraisal despite good feedback from internal customers and I have appealed. My line manager has offered me a discussion with HR on a compromise agreement.

It is difficult to advise precisely what you should look for in a compromise agreement as this will be dependent on the situation.

In all circumstances a valid compromise agreement must provide for an employer to make a financial contribution to the costs of you obtaining independent legal advice in respect of the agreement. By its very nature a valid agreement will compromise any rights you may have to bring a later claim at an employment tribunal. It is imperative that you obtain that legal advice in order to ensure that your financial position is not detrimentally affected and you do not unwittingly waive away any of your rights.
