What is the law relating to the setting of unfair or unattainable workplace targets?
What is the law regarding sales targets? How achievable do they have to be? Since the company changed my job role without my consent, I have been unable to hit the targets set. Also, they go up every month without the help of a new-business person passing me accounts (as it is for other employees). Targets sometimes given 1 week prior to the end of the month!
The law does not get involved over the specific setting of targets. If an employer has set sales targets that are quite unachievable and unreasonable, then this could amount to a breach of the implied term of mutual trust and confidence entitling an employee to resign and claim a constructive unfair dismissal.
Likewise, where an employer changes the job role, together with terms and conditions of an employee, without consent might also be a breach of the implied term of mutual trust and confidence entitling an employee to resign and claim a constructive unfair dismissal.
The success of this would depend the contents of any contractual clause relating to targets and how they were set but if you cannot achieve what you are being asked you should certainly write a letter of grievance setting out your concerns.
