Security guard injured by contractor in racially motivated assault...
I work as a security officer at a office site. One of my colleagues who is contracted by his company as a maintenance contractor worked at the same site. On 10th July month he attacked me in the security control room in what seems to have been a racially motivated attack. After racially abusing me he suddenly head butted me and gave me a broken nose and I lost lots of blood. I went to the police who are investigating. I lost my site where I work and my company put me on a disciplinary. My question is that if police found him guilty can I sue him for my fractured nose. Is there any chance I can also get compensation from him or my company for my nose or lost income? I gave my company a three week sick note from my GP because they asked me to do so and am only receiving statutory sick pay when I am losing around £130 a day...
It is difficult to answer this question without knowing all the details of the assault. I cannot understand why you were disciplined by your employer because you were the victim of a racial assault.
If the maintenance contractor assaulted you whilst performing his employment duties (i.e whilst at work), you may be able to bring a claim against his employers for personal injury - which will include a claim for loss of earnings. Your assailant does not have to be charged by the police in order for you to be able to sue his employers as the standard of proof for criminal proceedings is higher than it is for civil claims such as personal injury.
