My employer has reduced my salary by £6,000 per annum without my written agreement. What action can I take?

My employer has reduced my salary by £6,000 per annum without my written agreement. No new contract has been supplied and nothing has been signed by myself to accept this pay cut. I have today also been paid on the new salary scheme. Is this allowed? What action do I now need to take?

The payment terms of an employee’s wages are determined by contract and therefore cannot be varied without the express agreement of both parties. From the information provided it would appear as if you may have a claim for constructive dismissal based on breach of contract. This would require you to resign, raise a grievance and, if not satisfied with the response, commence a claim in the employment tribunal.

If you do not wish to quit your job at this stage you may be best advised to invoke your company’s grievance procedure first. You should, as soon as possible, write a detailed letter explaining the nature of your grievance to which your employer should respond within 28 days. Included within your letter you should state you are working under the new terms in protest. If your employer does not respond or if you are still not happy with the response you can then ‘stand and sue’ by commencing a formal claim.
