I began my maternity leave on the day that my employer went into administration. Can I be made redundant? Am I still entitled to my maternity package?
I began my maternity leave on the day that my employer went into administration. Can I be made redundant? Am I still entitled to my maternity package? I have been with the company for six years.
Sorry to hear that.
If the Company is being run by administrators - normally a firm of accountants - then they can make redundancies, but they still have to contact you to follow a consultative process.
If the administrators are still paying people then you should continue to get maternity benefits.
However, if the Company is wound up and you are made redundant then you would need to claim the balance of your SMP entitlement from the Benefits Agency.
