I am a store manager for a grocery store chain. I believe the Working Time Regulations entitle me to twenty days holiday per year. Due to pressures of work I have not taken this entitlement for the last two years. My question is, has my employer breached the Working Time Regulations by not monitoring my holidays taken to ensure I have taken the regulatory requirement?
With effect from October 2007 you are entitled to twenty four days holiday a year under the Working Time Directive if you work full time.
Your employer has only breached the Working Time Directive if they have denied you the opportunity to take your holidays, but it is not solely their responsibility to ensure you take your holidays, that is also your responsibility.
