Can I have disciplinary action taken against me if I don't have a contract? I had a family emergency and had to leave but I left my work place more than covered according to our care standards. However six days later, without notice, my employer took me into a meeting and said that they are going to investigate the matter because it was gross misconduct as I had left the service vulnerable. I have been a full-time permanent staff member for over a year now and I don't have a contract. Can they still take disciplinary action against me?How do I prevent this? Will I have to hand my notice in?
Your employer can take disciplinary proceedings but you are entitled to see a full disciplinary and grievance procedure. DO NOT resign to avoid the matter. Attend any hearing and see what the outcome is. Take further advice then.
