In sexual harassment cases it is how the offending conduct or act affects the victim and not the intention of the perpetrator that counts. If the conduct is unwanted and can be shown to have violated the victim's dignity or created an intimidating, hostile, degrading, humiliating or offensive environment for him or her then it is unlawful. A claim for sexual harassment must be commenced within 3 months of the date of the last incident or if the company’s grievance procedure is invoked this will extend the time limit by a further 3 months.
