Can we claim for back pay from old company if obligations were not met even if new company has taken over?

Can we claim for back pay? My wife's company was taken over on 01/07/07. The new company has kept everyone's old contracts. They made a mistake with wages and have paid both casual and contracted staff double time for Sundays whereas the old company only paid contracted staff double time on Sundays. My wife had a contract with the old company from April 2006 and is still employed at the same place. She only found out this evening that she should have been getting double time on Sundays when one of the managers let it slip. Is it too late to claim back pay with the old company?

When your wife's previous employer was taken over on 01.07.07 all the contracts and obligations pass from the old employer to the new employer who has purchased the business. Therefore if your wife has a question over back pay she needs to raise it with her current employer - not the old one who has since sold the business even if it took place on the old company's watch.
